URGENT PRESS RELEASE: Detection of Yemeni secret negotiations with the United Nations to establish a special international criminal tribunal to the terrorist attack on Yemen presidential mosque -styled as assassination of Hariri tribunal in Lebanon, and the (Maonah) Association welcomes this move.


(Maonah) Association for Human Rights and migration was informed by "credible" sources with the country that several parties in the government of Yemen including the the Yemeni President party agreed to start negotiations with the Secretary General of the United Nations through his Special Representative, who will visit Yemen, regarding help to create a special international criminal tribunal in Yemen on the issue of the terrorist attack on the leaders of the Yemeni state inside the presidency mosque in 3 | 7 | 2011, which resulted in the killing of 13 people and about 250 people were seriously injured, the terrorist brutal attack targeted the President of the Republic of Yemen and the Prime Minister and the House of Representatives and led to the death of the Shura Council leader and leaders of the Supreme State in Yemen as well as civilians and military personnel during the Friday prayers on the first day of Rajab at the presidential palace mosque .

The " Maonah " statement pointed out that the Yemeni authorities had rushed after the incident to involve investigators and international experts in addition to its competent authorities to investigate the terrorist crime that displays the symbols and leaders of Yemen, according to leaks, the initial investigation conducted by the Yemeni security services and currently being undertaken by the Public Prosecution, have revealed the involvement of leaders of , religious, tribal political party, and proved a major military involvement in the commission of such crime and financial support they received from the chief of state and foreign parties, which makes it international terrorist incidents.

The " Maonah " statement said that the legal basis that is based upon this request is based upon the UN Security Council Resolution No. 2014 on Yemen, the UN resolution explicitly unanimously condemned this criminal incident and considered it a terrorist crime, it was also explicitly condemned by the Human Rights Council at its eighteenth cession in Geneva, as condemned by the Secretary-General of the United Nations and the European Union and all countries of the world and local, regional and international human rights organizations , and everyone considered it a heinous terrorist crime and demanded to disclose the perpetrators and bring them to justice.

The association said in its statement that there are reasonable grounds to Yemen to create this type of "Internationalized" justice, most notably that it is difficult for the local Yemeni judicary "now" to be considered individually because of the weakness and division that mired the poor security situation in Yemen because of the ongoing political crisis since the early last year, in addition to that it had never to eliminate the Yemeni consideration of the issues of international terrorism is similar, due to the presence of international actors can not be brought before national courts, in addition to the existence of other necessitate reasons for the creation of this kind of international justice .

The " Maonah " statement said that the sources revealed about a consensus of political parties of Yemen to establish a special international criminal tribunal in Yemen for the crime of Alnahdain, because it will show the extent of compliance of Yemen to the international legitimacy resolutions that have condemned this crime, and that its establishment would be a internationally and locally guarantee sufficient for the prosecution and bring all those involved and local officials and international participants of committing this crime are brought to justice for punishment, like the Special Criminal Court for the assassination of Rafik Hariri in Lebanon.

The " Maonah " statement said that it welcomes this step and encourages President Saleh and the Yemeni government to immediately start negotiations with the Secretary General of the United Nations on the agreement on the establishment of this mixed Tribunal for the crime of the terrorist attack on a presidency mosque because such a decision would be a decision consistent with the obligations of the Government of Yemen in the fight against international terrorism, especially since the establishment of such "internationalized" courts is a real guarantee for the prosecution of the accused and bring all those involved in terrorist crimes on the background of political conflicts, whether domestic terrorists or their international partners and bring them to justice and ensure no impunity.

The Association asked of all the countries of the world, as well as local and international organizations especially interested in human rights aspects of support and encouragement for such a move, which intends to Yemeni government taking it and included "internationalized" this terrorist crime committed for political purposes and targeting innocent lives of leaders and politicians in Yemen, and help to accelerate procedures in the establishment of the international Tribunal for Yemen.
